These Terms of Service ("Terms") govern your use of frognoggin.com and its subdomains (the "Site"), operated by Frog Noggin ("we," "us," "our"), including our puzzle games, accounts, and related features (the "Services"). By accessing or using the Site, you ("User," "you") agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 13 years old to create an account or use the Services. By creating an account, you confirm that you meet this requirement.

2. Accounts

  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • Account information you provide must be accurate.
  • We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or attempt to compromise the Services.
  • You may delete your account at any time via your account settings.

3. Acceptable Use

When using the Services, you agree not to:

  • Use bots, scripts, or automated tools to interact with the Services or extract puzzle data/solutions
  • Attempt to reverse-engineer, scrape, or systematically extract puzzle content, answers, or underlying game logic
  • Interfere with or disrupt the Services, including attempts to overload or attack our systems
  • Impersonate another person or misrepresent your identity
  • Harass, abuse, or harm other users, including through any social, leaderboard, or sharing features we may offer now or in the future
  • Use the Services for any unlawful purpose

4. Intellectual Property

The Services, including all puzzle games (Neighbors, Frogscotch, and any future games), designs, mechanics, branding, and underlying code, are operated by Frog Noggin. The underlying code, visual designs, artwork, written content, and puzzle content are protected by copyright. We grant you a limited, personal, non-exclusive, non-transferable license to use the Services for your own personal, non-commercial use. You may not copy, redistribute, modify, reverse-engineer, or commercially exploit any part of the Services without our written permission. You do not acquire any ownership interest in the Services, its content, or any features you may access.

Content you submit to us, such as bug reports or profile information, helps us operate and improve the Services, and you agree we can use it freely for that purpose. This doesn't create any payment or ownership obligation on our part.

5. Payments and Subscriptions

If we offer paid features or subscriptions, additional terms regarding pricing, billing, and cancellation will be presented at the time of purchase and form part of these Terms. Payments are processed by Stripe; see our Privacy Policy for details. You may cancel a subscription at any time through your account settings.

6. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or entirely secure.

Nothing in this section affects your statutory rights as a consumer under UK law, including rights under the Consumer Rights Act 2015 that cannot be excluded by agreement. Some other jurisdictions also do not permit the exclusion of certain warranties or limitations of liability; if applicable law does not permit an exclusion in this section, that exclusion will not apply to you.

Frog Noggin is run by a small team, and we're not obligated to provide ongoing support, maintenance, or updates on any particular schedule. We'll do our best to fix bugs and respond to issues, but there's no guaranteed response time or fix timeline.

7. Limitation of Liability

To the fullest extent permitted by law, Frog Noggin shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total liability for any claim relating to the Services shall not exceed the amount you paid us, if any, in the 12 months preceding the claim, or £10 if you have not made any payments.

8. Indemnification

You agree to indemnify and hold Frog Noggin harmless from any claims, damages, or expenses arising from your misuse of the Services or violation of these Terms.

9. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms. You may stop using the Services and delete your account at any time.

Sections of these Terms which by their nature should survive termination (including but not limited to Intellectual Property, Indemnification, Limitation of Liability, and Disclaimers) will continue to apply after your account is terminated or you stop using the Services.

10. Changes to the Services or Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms; if changes are material, we will provide reasonable notice (e.g., via the Site or email). Continued use of the Services after changes take effect constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Entire Agreement and Assignment

These Terms constitute the entire agreement between you and Frog Noggin regarding your use of the Services, and supersede any prior agreements or understandings, whether written or oral. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms, in whole or in part, at any time, including in connection with a merger, acquisition, or sale of the business.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
